Acceptance of Terms
By accessing or using the OnlySeriousEmail service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Description of Service
OnlySeriousEmail is an email filtering and delivery confirmation service. We route incoming email through a payment-gated system that allows recipients to control access to their inbox. The Service is provided "as is" and "as available" without warranties of any kind.
Use at Your Own Risk
You expressly understand and agree that your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. Dark Magic Labs, LLC and its affiliates, officers, employees, agents, partners, and licensors expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of any content
- Uninterrupted or error-free operation
- That defects will be corrected
- That the Service is free of viruses or other harmful components
Limitation of Liability
To the maximum extent permitted by applicable law, Dark Magic Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to, use of, or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Delayed, lost, or undelivered email messages
- Errors, mistakes, or inaccuracies of content
- Any interruption or cessation of the Service
- Any bugs, viruses, or other harmful code transmitted through the Service
In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid us in the last six (6) months, or fifty dollars ($50.00), whichever is greater.
No Guarantee of Delivery
We do not guarantee that any email message will be delivered, received, or read by its intended recipient. Email delivery depends on many factors outside our control, including recipient mail servers, spam filters, network availability, and user actions. You acknowledge that email is inherently unreliable and agree not to hold us responsible for failed, delayed, or lost messages.
Indemnification
You agree to defend, indemnify, and hold harmless Dark Magic Labs, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:
- Your use of and access to the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including intellectual property or privacy rights
- Any claim that your use of the Service caused damage to a third party
User Conduct
You agree not to use the Service to:
- Send spam, unsolicited bulk email, or phishing messages
- Harass, abuse, or harm another person
- Violate any applicable laws or regulations
- Transmit malware, viruses, or other malicious code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers
We reserve the right to terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including breach of these Terms.
Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Wyoming.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between you and Dark Magic Labs, LLC regarding the use of the Service and supersede all prior agreements and understandings.
